Il presente documento costituisce l’integrazione ai Termini e Condizioni del contratto di locazione turistica sottoscritto dal Conduttore. La versione inglese è fornita per comodità e cortesia internazionale; in caso di divergenze interpretative o dispute legali, prevarrà il testo in lingua italiana e l’applicazione della legge italiana.
This document constitutes the full General Terms, Legal Conditions, and House Rules governing your stay with Burghesius S.r.l. By signing your rental agreement or accessing the property, you agree to the following terms in full. This English version is provided for convenience; in the event of any discrepancy, the Italian text and Italian Law shall prevail.
1. INSPECTION, ACCEPTANCE, AND “AS-IS” CLAUSE
Upon receiving the keys or access codes, the Guest is required to conduct a prompt inspection of the premises. By taking possession of the property, the Guest formally acknowledges and agrees to the following:
Property Condition: The Guest acknowledges that the property is in excellent maintenance condition, clean, fully functional, and perfectly consistent with the photographs and descriptions provided at the time of booking.
Acceptance “As-Is”: The Guest accepts the property in its current state. Consequently, the Guest expressly waives any right to future claims, price reductions, or disputes regarding the property’s aesthetics, layout, or furnishings.
No Grounds for Dispute: The parties expressly agree that once the stay has commenced, there are no grounds for payment disputes, refund requests, or credit card chargebacks related to the property’s condition, maintenance, or compliance.
2. HOUSE RULES AND PROHIBITIONS
To ensure the safety of our guests and the peace of the neighborhood, the following rules are strictly enforced:
Noise & Silence: Absolute silence must be observed between 10:00 PM and 08:00 AM. Any behavior causing disturbance to neighbors may result in immediate eviction.
No Smoking/Vaping: Smoking or vaping of any kind is strictly prohibited inside the premises. A professional sanitization and deep-cleaning fee of € 500.00 will be charged to violators.
Parties & Events: Organizing parties or events is strictly forbidden.
Unregistered Guests: Only guests registered via the mandatory “Alloggiati Web” procedure are allowed to access the property. Introducing non-registered persons is a breach of Italian Public Safety Laws (Art. 109 T.U.L.P.S.) and will result in a € 500.00 penalty and immediate termination of the stay.
3. CHECK-OUT AND PENALTIES
Check-out Time: Guests must vacate the property by 10:00 AM.
Late Check-out Fees: Unauthorized occupancy of the property beyond 10:00 AM will incur a penalty starting from € 75.00. For delays exceeding 3 hours (after 1:00 PM), a penalty of up to € 250.00 will be applied to cover operational disruptions, emergency housekeeping rescheduling, and potential compensation for incoming guests. The specific fee within this range depends on the size and category of the property.
Lost Keys/Remotes: Loss of keys or building remote controls will incur a charge of € 250.00 to cover lock replacement and security updates.
4. DAMAGES AND SECURITY GUARANTEE
The Guest is fully liable for any damage caused to the property, furniture, or common areas.
Authorization: Burghesius S.r.l. is expressly authorized to deduct the cost of repairs from the security deposit or charge the credit card provided as a guarantee for any damages or penalties mentioned in these terms.
5. LIMITATION OF LIABILITY (TECHNICAL FAILURES)
Burghesius S.r.l. maintains high standards for all amenities. However:
Third-Party Services: Burghesius is not responsible for temporary disruptions caused by third-party providers (e.g., internet/Wi-Fi outages, city-wide power cuts, water maintenance, or elevator repairs).
Maintenance: No refunds or discounts will be granted for technical failures beyond the Lessor’s direct control or for repairs that can be resolved within 24-48 hours.
Personal Belongings: Burghesius is not liable for theft, loss, or damage to personal belongings left inside the property.
6. RIGHT OF ENTRY
Burghesius S.r.l. or its authorized personnel reserve the right to enter the property during the stay for emergency repairs (e.g., water leaks), mandatory safety inspections, or if there is reasonable suspicion of a breach of House Rules.
7. BILLING, TAXES, AND PRIVACY
City Tax: The Tourist Tax (Contributo di Soggiorno) for the City of Rome is a mandatory municipal tax required by Italian law. It is not included in the rental price and will be calculated and settled upon booking, based on the number of guests and nights as per the City of Rome’s current regulations.
Police Registration: According to Italian Law, all guest details will be transmitted to the State Police portal (Alloggiati Web). Data is processed according to GDPR 2016/679 for legal and fiscal purposes only.
8. GOVERNING LAW AND JURISDICTION
This agreement is governed by the Laws of the Republic of Italy. Any dispute arising from this contract shall be subject to the exclusive jurisdiction of the Court of Rome (Foro di Roma).
